COMPETITION TERMS & CONDITIONS
ELIGIBILITY:
This Competition is open to any legal South African resident, excluding: All AtomGate staff; any person who is a supplier of goods and services in connection with the Competition; anyone else professionally connected with this Competition; and any of the aforementioned people’s spouses, life partners, parents and children. By entering this Competition participants warrant that they do not fall into any of the aforementioned categories of people. Should it materialise that a participant falls into any of the aforementioned categories of people the participant shall automatically be disqualified from the Competition and forfeit and return any prizes that may have been awarded to that participant.
DURATION OF THE COMPETITION:
This Competition runs from 12:01:00 am on 30th November 2011 until 11:59:59 pm on 27th January 2011. Entries must be received by AtomGate after the Competition opening time and no later than the closing time indicated. Each entry constitutes full and unconditional acceptance of these Rules. AtomGate reserves the right to disqualify anyone in breach of these Rules.
SELECTION OF WINNER:
The Competition will be run in the format of a lucky draw. One winner will be randomly drawn from all the valid entries submitted at the end of the Competition. The random draw to determine a winner will take place at AtomGate on the 30th January 2012. The random entry drawn will be checked to establish whether it meets the eligibility criteria above and if it does, that entry will be the Competition winner, subject to us being able to contact that winner within 5 days of the draw taking place. If the eligibility criteria is not met, further random draws will take place until a randomly selected valid entry meets the eligibility criteria. The winner will be notified telephonically within 48 hours of the random draw taking place by way of a telephone call and email to the telephone number(s) and email address we have access to. If a potential winner cannot be contacted, through no fault of AtomGate, 5 days after the first attempt, the prize will be awarded to the next randomly drawn eligible winner. The random draw(s) will be overseen by an independent accountant, registered auditor, attorney or advocate.
PRIZES:
The Competition winner will receive an iPad 2 16GB (3G and Wi-Fi compatible) with an approximate value of R5600. AtomGate will deliver the prize to the winner's selected physical address within one week of notification. The prize is not transferable or negotiable. No cash alternatives are available. AtomGate reserves the right to substitute the prize for other prizes of equal or greater value. AtomGate is not responsible for any damaged prizes after signature acknowledging receipt of the prize. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
WINNERS LIST:
Unless you instruct us to the contrary within 24 hours of being notified that you have won a prize, if you enter this competition, you consent to your name, image and prize being announced on the AtomGate Facebook Fan page, the AtomGate Twitter page and the AtomGate website. If the winner's consent is not withheld, the winner's name will be available on the AtomGate Facebook Fan page and the AtomGate website for a period of 3 months after the close of the Competition.
DATA USE AND PRIVACY POLICY:
Participants in the Competition understand and agree that, in order to offer the Competition, AtomGate may collect and use personal information about participants. This personal information may include participants', first name, last name, email address, mobile number and in certain instances your image. Personal data, which participants provide when they enter the Competition, may, subject to prevailing law, be used for future AtomGate marketing activity, unless you notify AtomGate that you wish to opt out of receiving such marketing communications. AtomGate will treat your information in total confidence and will not sell, share or rent this information to any other third parties. AtomGate may disclose information if required to do so by law or if it is required to protect the safety, rights or property of AtomGate, our members, customers or the public. The information collected by AtomGate is stored in a secure operating environment that is not available to the public.
GENERAL:
No correspondence will be entered into regarding either this Competition or these Rules. In the unlikely event of a dispute, AtomGate's decision shall be final. AtomGate reserves the right to amend, modify, cancel or withdraw any aspect of this Competition in its sole discretion at any time without notice or liability. AtomGate cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this Competition agree that AtomGate will, subject to prevailing law, have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this Competition. The laws of the Republic of South Africa govern this Competition. If any provision or part of these Rules is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these Rules shall remain in force. Any violation of these Rules will result in the immediate disqualification of the transgressing participant from the Competition.
